ENGORON GAG ORDER SHREDDED BY APPEALS COURT JUDGE

Last week I wrote about Engoron’s boneheaded statement that he was not there to hear Trump speak at Trump’s own trial. This week the chickens have come home to roost, and Trump’s gag order was lifted in appeals court. [1]
President Trump allegedly made a comment on the clerks on his Truth Social platform that the Judge believed was false, which initiated the gag order. But the new judge, Judge David Friedman, cited freedom of speech concerns as the court process is going to be lengthy. [1]
This comes as Trump reportedly filed a mistrial with the higher court over how Engoron treated the case. [2] As I stated last week, Trump could use Engoron’s conduct to make his life a spectacle, and it appears Trump has, in fact, taken this route with the mistrial filing.

Trump’s 30-page mistrial filing states “This Court has also impermissibly exceeded its discretion in granting his Principal Law Clerk unprecedented status and input into these proceedings and restricted the speech of anyone who seeks to comment on this status, input and/or perceived partisan bias.” [2]
In Engoron’s original gag order it stated “All counsel are prohibited from making any public statements, in or out of court, that refer to any confidential communications, in any form, between my staff and me.” [3] This appears to align more with Trump’s lawyers’ interpretations of events than that of the mainstream liberal media’s take of Trump “repeatedly targeting” the clerk. This is a good ruling, since the Constitution allows freedom of speech. It also shows that there is some impartial judicial work going on in New York’s political system.
Trump’s got a great chance to improve his public image with this gag order lifted, but will he use it appropriately?
So far as I can tell, his lawyers certainly are. Trump attorney Christopher Kise stated “the public will again have full access to what is really taking place in this unprecedented trial.” [4] What a bold yet agreeable statement.
But Trump does have to be careful. He can’t just go back onto Truth Social and lambast the judge and his staff going forward. Just because he got this gag order lifted, that doesn’t mean Engoron or some other judge can’t simply place another one onto him. Plus, Trump has multiple other lawsuits he is dealing with; the other judges could also place similar gag orders onto him as well.
But that doesn’t mean Trump can’t say anything, either. Trump’s First Amendment rights are still rights. If he is strategic with his responses, he can say precisely what he wants to in such a way that it will highlight potential injustice if the media gets triggered by it and the judge doesn’t try to hide it.
But, considering it is Trump, he is likely less concerned with what his judges think and more concerned with rallying the voters so he wins the 2024 Presidential grudge match. His stylistic delivery is great for this purpose, but could land him into more legal hot water.
Perhaps if he takes a page from the playbook of Vivek Ramaswamy, he might be able to express his ideas less dangerously to his legal situation. Since Ramaswamy has found a way to repeat the same concerns Trump has without the potential lawsuits.
Then again, the lawsuits themselves have become a crowd-pleaser, and rightfully so. In democracies the political opposition isn’t investigated out of existence. That only happens in fascistic and/or dictatorial countries. This begs the question… what government are we currently living under where this is happening to us?
